1. INFORMATION ABOUT US:-
1.1 We operate the website www.totallywickedisleofman.im. We are Craig Wood Business trading as Totally Wicked Isle of Man, a trading name registered in the Isle of Man under approval number 29203A and with our registered address at Totally Wicked Isle of Man, 7 Market Hill, Douglas, Isle of Man, IM1 2BF. Our VAT number is 004 4373 14
1.2 Contacting us:
(a) You can e-mail us at info@totallywickedisleofman.im or contact our shop by telephone on 01624 616205. If you are emailing us please include details of your order to help us to identify it.
(b) If we have to contact you or give you notice in writing, we will do so by e-mail or by text message to the number you provide to us in your order.
2. OUR PRODUCTS:-
2.1 The descriptions and images of the Products on our site are for illustrative purposes only, we attempt to make them as accurate as possible but are not responsible for minor differences. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. Your Products may vary slightly from those images.
2.2 The packaging of the Products may vary from that shown on images on our site.
2.3 We reserve the right to withdraw any Products from the website at any time and we shall not be liable to anyone for withdrawing any Products from the website or for refusing to process an order.
3. HOW WE USE YOUR PERSONAL INFORMATION:-
We only use your personal information in accordance with our Privacy Policy. Please take the time to read our Privacy Policy, as it includes important terms which apply to you.
4. AGE OF CONSENT:-
You may only purchase Products from our site if you are at least 18 years old. You will be asked to declare that you are of the appropriate legal age to purchase the Products when placing an order and we may carry out independent verification to check your age and if we discover that you are not legally entitled to order the Products, we shall be entitled to cancel the order immediately, without notice. If you falsely declare your age to us you shall be held responsible for all costs, expenses, losses, damage fines and other penalties that we may suffer or incur as a consequence of your false statement. By ordering Products from this website, you hereby consent to us undertaking a search by asking you to produce some identification in the form of Passport, Driving License or Government 18+ Card for the purposes of verifying your identity. We may also use your details in the future to assist us for verification purposes.
5. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US:-
5.1 Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
5.2 After you place an order, you will receive an e-mail from us confirming the details, description and price of the Product and acknowledging that we have accepted your order. You will receive details of how to pay us, if you have chosen bank transfer you will be sent the details automatically, if you have chosen card payment link you will be sent a link manually to your email or phone number provided.
5.3 The Contract between us will only be formed when you receive your order.
6. YOUR RIGHTS TO END THE CONTRACT:-
6.1 If you change your mind about your order of the Products you have 14 days after the day you (or someone you nominate) receives the Products, unless:
(a) Your Products are split into several deliveries over different days. In this case, you have until 14 days after the day you (or someone you nominate) receives the last delivery to change your mind about the Products.
(b) Your Products are for regular delivery over a set period. In this case, you have until 14 days after the day you (or someone you nominate) receives the first delivery of the Products.
6.2 You have the right to a refund or replacement of a similar value if the product is unopened or unused.
7. OUR RIGHT TO END THE CONTRACT:-
7.1 Any order placed on our website has a 48 hour cancellation policy from the shop, this means that any order not paid for within 48 hours will be automatically cancelled.
(a) this will not apply If you have contacted us with a valid reason for no payment.
(b) You will be sent bank details and or card payment link to the email or phone number provided within and hour or ordering.
7.2 Any order ordered for collection and pay on collection payment method selected also has a 48 hours pick up policy, if your order has not been picked up within this time without valid reason you order will be cancelled and items put back our for sale.
8. IF THERE IS A PROBLEM WITH THE PRODUCT:-
8.1 If your device develops an issue or a fault for no reason you are entitled to a refund or a replacement if the item was bought within 6 months of the fault developing.
8.2 Please bring the item back to our Douglas store for further investigation, if we cannot fix your device you will be offered a new one.
9. DELIVERY:-
9.1 We offer a same day delivery service Monday to Friday on orders received before 2.30pm and paid for before 3pm.
9.2 We have set delivery zones throughout the week:-
Monday to Friday - IM1, IM2 and IM3 addresses (no further than Crosby)
Monday and Thursday - incl. IM9 addresses (Incl. St. Marks)
Tuesday and Friday - incl. IM7 and IM8 addresses (Incl. Laxey)
Wednesday and Thursday - incl. IM5 and IM6 addresses (Incl. Foxdale/St. Johns)
9.3 We do charge £2.00 delivery charge on orders below £19.99, free delivery on orders over £19.99.
9.4 There is a minimum order amount of £12.99 on addresses outside IM1, IM2 and IM3.
10. HOW TO PAY:-
10.1 We offer Bank Transfer, Card Payment via Trust Payments or Pay on Collection via Cash or Card.
10.2 We cannot accept American Express at this time.
11. OUR WARRANTY FOR THE PRODUCTS:-
11.1 Duration of warranty periods from date of purchase:
- Full kits – 6 months (N.B. some included accessories may differ)
- Battery units and mods – 6 months
- Tanks – 6 months
- Atomizer heads, open pod cartridges and pre-filled pods – consumable item, dead-on-arrival only
- Accessories (chargers, leads) – 12 months
- Individual battery cells – 6 months
11.2 You should be aware that our electronic cigarette atomizers although made to the highest quality, may fail or degrade over a period of time. An electronic cigarette atomizer's expected lifespan is around 7-14 days depending on usage.
11.3 The warranty in clause 11.1 to 11.2 does not apply to any defect in the Products arising from:
(a) fair wear and tear;
(b) wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;
(c) failure by you to operate or use the Products in accordance with the user instructions;
(d) failure by you to carry normal maintenance of the Products including regular cleaning of components and connectors;
(e) any alteration or repair by you or by a third party who is not one of our authorised repairers; or
(f) any specification provided by you.
11.4 This warranty is in addition to and does not affect, your legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
12. GUIDELINE FOR USE OF THE PRODUCTS:-
12.1 You agree that you will read and comply with any instructions and product warnings on the Products. You shall also read and follow the guidance contained in the Battery Safety Guide section of the Totally Wicked UK website.
12.2 You acknowledge that we are not a pharmaceutical company and do not produce medical products.
12.3 You also acknowledge that:
(a) the Products may be hazardous to health and are intended for use by adult smokers;
(b) the Products must be kept out of reach of children;
(c) the Products are not suitable for use by persons who are under the age of 18; pregnant or breastfeeding women; persons who are sensitive or allergic to nicotine; and should be used with caution by persons with or at a risk of an unstable heart condition or high blood pressure.
12.4 Nicotine is a highly addictive substance and overuse can lead to feeling unwell or developing headaches. If you experience and adverse effects from vaping consider lowering your nicotine strength or use your vape less or stop using the vape until you feel well again.
